MIKE’S hereby rents Vehicle (including any replacement vehicle) to Renter subject to all terms and conditions on the front page and this page and Renter in consideration thereof agrees to them as the essence of the Agreement. DELIVERY AND RETURN. The vehicle is delivered to the Renter in good overall condition and without apparent defects and any complaints as to its condition must be made immediately on delivery. The Renter agrees to return with all documents and accessories and in the same condition at the location and on the date designated in this agreement, otherwise Renter shall be responsible to compensate this addition to the normal rental charge. MIKE’S reserves the right to repossess the vehicle at any time without demand at Renter’s expense, if vehicle is used in violation of the agreement. DAMAGE etc. In the event of loss of damage to vehicle, Renter shall pay to MIKE’S the amount of all resulting losses and expenses, if he or the authorised driver violated these conditions, legal provisions or insurance regulations, intentionally or through gross negligence. As loss of revenue, Renter shall pay compensation if MIKE’S requests, corresponding to the rental charges, including a daily charge for at least 100 km, until the vehicle or a replacement vehicle will again be available to MIKE’S. It is for the Renter to prove lesser damage. In all other cases: a) Renter is not liable for loss of, or damage to, vehicle from fire or theft, (unless caused through his / authorised driver’s fault) b) If Renter has complied with all terms and conditions of this agreement but not otherwise, MIKE’S responsibility for direct and accidental loss or damage from collision is WAIVED by Renter’s acceptance Collision Damage Waiver at time of rental by initialling in the “Accept” box on the reserve side of this page. If Renter does not accept CDW, his responsibility remains. c) Renter is responsible for any further damages not covered by the insurance Policy. CHARGES. Renter shall pay MIKE’S on demand at termination of the rental unless agreed otherwise the sum of: a) All time and mileage charges computed at the rates shown on the front page of this agreement. b) All basic delivery and collection charges, when applicable to the rental. c) Any State taxes and service fees on the rental. d) MIKE’S costs including attorney’s fees, delayed interest incurred in collecting payments due from Renter under this agreement e) Fines Penalties, Forfeitures, Court costs and other expenses, if assessed against MIKE’S under compulsion of law with respect of use of Vehicle before its proper return to MIKE’S unless due to fault of MIKE’S but this shall not relieve Renter or authorised driver for their own unlawful conduct. f) Any amount for replacement of destroyed tyres, repairing mechanical damages and tear on the body of the vehicle. g) Granted discounts will be recalled, if settlement of account is not made within the set limits. h) All charges are subject to final audit. CONDITIONS OF USE. The Renter is expected to look after the vehicle carefully, to check its mechanical condition, oil, water, tires etc. Any damage of the Vehicle by Renter himself or any other party designated by Renter is not allowed without Lessor’s prior consent. In particular, Vehicle must not be used: a) To carry persons or property for hire b) To propel or to tow any vehicle, trailer or other object c) In race test or contests d) For subleasing by Renter to any third party e) While Renter or any other authorised driver of the Vehicle is under the influence of alcohol, hallucinatory drugs, barbiturates, or any other substance impairing his consciousness or ability to react f) In contravention of any customs, traffic or other regulations g) By any person other than Renter unless such person has been previously designated and authorised by MIKE’S in the space provided on the front page of this agreement h) To transfer or carry heavy luggage or objects, inflammable materials, staining of body smelling goods, narcotics etc. i) outside Greece without the advance authorization of MIKE’S in writing. EXTENSION OF RENTAL PERIOD. If Renter wishes to prolong the rental period of the Vehicle, he has to contact MIKE’S within 48 hours before the initial expiration time of the rental to obtain permission for the additional rental period Failing to do so will make Renter liable civilly and penalty for illegal use and possession of the Vehicle. In case of extension Renter shall be bound by the terms and conditions accepted by MIKE’S or in respect of any replacement Vehicle rented in lieu of the Vehicle. ACCIDENTS. In case of an accident or any other incident (fire, theft etc) Renter is responsible within 24 hours to follow the insurance procedures as set out below: a) Call the police b) Obtain names and addresses of eye witnesses c) Obtain and check opposite party’s claims d) Contact MIKE’S immediately by phone or other means e) Contain all relevant information from third party f) Send any other document or information relative to the accident to MIKE’S INSURANCE. a) MIKE’S provides insurance coverage for persons using vehicle with its permission (and not those defined in accordance with an authorized third party liability insurance policy, which is available for inspection) b) Renter, additional authorised drivers and passengers are not covered by personal accident insurance unless Renter accepts Personal Accident Insurance at the time of rental by initialing in the “Accept” box on the front page of here, after having agreed to the terms stated, in the current MIKE’S tariff. 8. PERSONAL DATA. Renter consents to the storage or other usage of his personal data. MIKE’S is authorised to pass on such data in those cases where they are stated as requirement made by partner or third parties or under circumstances where Renter violates this agreement. MISCELLANEOUS. a) Vehicle is the property of MIKE’S. This is an agreement of rental only. Renter is not Lessor’s agent for any purpose. Renter acknowledges that he acquires no rights other than stated in this agreement. b) All additional drivers are jointly and severally liable with the Renter under this agreement. c) Likewise in case that this agreement is signed by any representative of the Renter, he would be jointly and severally responsible with the Renter. d) This Agreement supersedes any other written or verbal Agreement between MIKE’S and Renter. e) MIKE’S cannot waive any of its rights deriving from the law and this agreement. 10. Cancellation Policy If you wish to cancel your reservation, you have to send a cancellation notice email and receive an answer that we received your cancellation notice. There is no cancellation fee if we receive the cancellation notice up to 7 days before the due pick-up date and time. If we receive the cancellation notice up to 7 days prior to the due pick-up date and time, then the 20% of total reservation amount will be charged. 11. No show policy 20% cancellation fee is charged upon a no show
